1. Introduction

These Terms and Conditions (“Terms”) set out the agreement between you (“you”) and OneFootball GmbH of Donaustrasse 44, Berlin 12043, Germany (“OneFootball”) and govern your participation in the OFC Moca Raffle (“Raffle”). By participating in the Raffle, you agree to these Terms in full.

2. Eligibility

The Raffle is open exclusively to people and entities holding at least 1 full set of all 3 NFTs of OneFootball's Open Edition Mint (“Eligible Users”). These 3 NFTs are exclusively obtainable through the third-party website under the URL https://wallet.coinbase.com/nft/mint/onefootballclub which is operated by Coinbase Technologies Inc. and under the URL https://club.onefootball.com/join which is operated by OneFootball.

You must be 18 years of age or older to participate in the Raffle and resident in either the United Kingdom or Germany.

All employees of OneFootball and its subsidiary entities are excluded from participation.

3. Raffle Entry

Eligible Users automatically enter the Raffle.

4. Earning Raffle Tickets

Raffle tickets are awarded based on how many full sets of OneFootball's Open Edition Mint you hold in your wallet.

5. Raffle Period

The Raffle shall be conducted once. The Raffle period begins at the time of announcement and ends on Sun Oct 20th 2024 9am PST.

6 Prize Details

7. Winner Selection

The winner will be randomly selected from all eligible entries using an automated system after the Raffle period ends.

If no participants are eligible for the Raffle, the selection process will run as an empty process with no winner selected.

8. Notification of Winner

The winner will not be contacted individually.

9. Prize Distribution

The Prize will be distributed within 7 days after the end of the Raffle Period, subject to verification of eligibility and compliance with these Terms. The Prize will be airdropped from OneFootball to the winner's wallet.

10. General Conditions

OneFootball reserves the right to cancel the Raffle in whole or in part at any time without prior notice and without giving reasons. This applies in particular if the Raffle cannot be carried out as planned, e.g. in the event of computer viruses, software and/or hardware errors and/or for other technical and/or legal reasons. This also applies in the event of manipulation(s) or attempts at manipulation that affect the proper organization of the Raffle.

11. Privacy

By participating in the Raffle, the participant expressly agrees that their contact details will be processed by OneFootball solely for the purpose of fulfilling the contract for the shipping of the competition prize(s). 12. Limitation of Liability

OneFootball is not liable for false information that is expressed and disseminated by participants and/or third parties, including any cooperation partners of OneFootball, in connection with the dissemination of information about the competition.

OneFootball is not liable for damages caused by the failure of technical equipment, for delays or interruptions in transmissions or for damages incurred in connection with participation in the competition or with the acceptance and use of the prize, unless OneFootball or its vicarious agents act with wilful or gross negligence. Claims for damages due to injury to life, limb, health or essential contractual obligations remain unaffected.

Otherwise, the liability of OneFootball and its vicarious agents for contractual breaches of duty and for offenses is limited to intent and gross negligence. This does not apply to injury to life, body and health of the participant or claims due to the breach of cardinal obligations, i.e. obligations that arise from the nature of the contract and whose breach jeopardizes the achievement of the purpose of the contract.

13. Governing Law

These Terms are governed by and shall be construed in accordance with the laws of the Federal Republic of Germany, to the exclusion of the provisions of international private law. Legal recourse is excluded.
